I. POSTAL ACTIVITIES
The creation, operation and provision of postal services are subject to the regimes of exclusivity, authorization or simple declaration, as appropriate.
Are subject to the exclusivity regime: the creation, operation and provision of letter-post services which weight does not exceed 50 grams, as well as postage stamps and any other payment methods, postal orders and postal checks service.
The fast-track collection, routing and delivery of documents and postal parcels to or from abroad are subject to the authorization regime.
The authorization is granted to any person whether natural or legal wanting to create, operate and /or provide postal services subject to the authorization regime, pursuant to the regulations in force and the terms set forth by the Regulatory Authority, by observing the principles of objectivity, transparency and non-discrimination.
- Procedures
The authorization application shall include the following documents:
For legal person
- the applicant’s identity (company name, corporate form, legal representative, registered office);
- a copy of the trade register,
- a copy of the statutes;
- a copy of the official bulletin for legal notices bearing the incorporation publication,
- a copy of the legal representative’s ID card,
- a copy of the annual corporate accounts of the last two financial years (if any);
- the nature, technical and commercial features of the planned project comprising: a description of the commercial activities, planned investments and staffing plan, service quality indicators, general conditions of sale and transport as well as agencies’ launching plan,
- information about the technical and financial capacity to achieve the expected project,
- proof of payment of the file fees;
- An official commitment letter to comply with the regulatory and legislative laws in force, the Regulatory Authority’s decisions and the current specifications provisions;
- the proposed rates to clients with all taxes included,
- a copy of the agreement, if any, concluded between the company and foreign corporations for the delivery of international mail..
For natural person:
- a copy of the trade register,
- a copy of the applicant’s ID card,
- information comprising:
– The nature, commercial and technical features of the planned project;
– The plan of agencies’ launching;
– The general terms for sale and transport;
– Tables of service quality indicators,
– The rates proposed to clients (all taxes included),
– A description of the planned investments and the staffing plan,
- information about the financial and technical capacity of the holder of the planned project,
- proof of payment of the file fees,
- An official commitment letter to comply with the regulatory and legislative laws in force, the Regulatory Authority’s decisions and the current specifications provisions;
- a copy of the agreement, if any, concluded between the applicant and foreign corporations For the delivery of international mail.
The file shall be sent to the Regulatory Authority in two (2) copies, an original and a copy, either:
- by mail through a registered letter with acknowledgement of receipt to the General Director of Regulatory Authority of Post and Electronic communications, to the address: 1 rue Kaddour Rahim Hussein Dey , 16005 -Algiers.
- Or by submission to the Regulatory Authority’s headquarters, to the att. of Mr. General Director. The relevant service shall provide a confirmation receipt.
- Renewal
The application for renewal shall be submitted, within the same timeframe of the first application, 45 days prior to the end of authorization.
The creation, operation and/or provision of postal services for handling local express mail are subject to the simple authorization regime within the limit of weights defined by the regulation, i.e. a weight exceeding 50 grams.
- Procedures
The application for registration certificate to operate postal services subject to the simple declaration regime shall be include the following documents:
For legal person
- Déclaration d’intention d’exploitation des services postaux relevant du régime de la simple déclaration;
- Copies des actes juridiques justifiant sa jouissance de son local, ainsi que de ses points de présence;
- Copie des statuts de création d’une entreprise;
- Copie du registre de commerce;
- Un justificatif de paiement des frais de gestion du dossier d’un montant de 33.320,00 DA TTC au profit de l’Autorité de Régulation de la Poste et des Communications Electroniques (ARPCE) Banque CPA Agence d’Hussein Dey : N° 004 00118 40 10004695 40.
For natural person
- Declaration of the will to exploit postal services subject to the simple declaration regime (to be downloaded),
- Copy of the legal contracts proving the enjoyment of its premises and points of presence,
- Legal record,
- Copy of trade register,
- proof of payment of file handling fees amounting to , 320,00 DZD all taxes included, by bank transfer, certified cheque or cashier’s cheque for the Regulatory Authority (ARPCE), Banque CPA Agence d’Hussein Dey : N° 004 00118 40 10004695 40.
- Renewal
The renewal of the registration certificate must obligatory be the subject of an express application addressed by the operator to the Regulatory Authority within 45 days, with a return receipt, prior to the expiry of validity period of his registration certificate.
II. APPROVAL OF POSTAL EQUIPMENT
Any equipment intended to be used to provide postal services shall be subject to an approval certified by a conformity certificate.
It is worth mentioning that the postal equipment is approved once only. The conformity certificate issued for the first applicant is valid for any future acquisition, of the same postal equipment, by any other person.
Are subject to the approval, the following postal equipment:
- Franking machines,
- Stamp cancellation machines,
- Stamping equipment,
- Automatic sorting machines;
- Automatic postage stamp dispensers;
- Postal sorting tables and racks;
- Time-stamping machines for money orders and mail;
- Mechanic and electric sorting platforms,
- Inserters and sealers for letters, documents and catalogs;
- Post boxes installed in post offices;
- Mailboxes installed on the public highway, wall-mounted and/or column-mounted;
- Post box batteries installed inside post offices.
- The conformity certificate shall be issued by the Regulatory Authority or a testing and measurement laboratory dully authorized by the aforementioned Authority, after payment of approval fees according to the terms set forth by regulation.
- The application for approval of postal equipment accompanied with two (2) files, administrative and technical, shall be submitted to the Regulatory Athority of Post and Electronic CommunicationsRPCE.
The administrative file shall comprise:
- A copy of the trade register,
- A copy of tax registration card,
- A proof of payment of the file’s handling fees.
The technical file shall comprise:
- An original certificate of equipment subject of the approval application, if about imported equipment,
- The technical documents containing equipment pictures, trademark, model, serial number, country of manufacture.
- A sample of the concerned equipment, if necessary. The sample must be returned to the applicant as soon as tests end.
The period of handling the approval application shall not exceed two (2) months, as from the date of application submission, certified by a return receipt.
The rejection of approval application must be justified and notified in the same deadlines aforementioned.
The rejection of approval application might be subject to appeal before the State’s Council pursuant to the legislation in force.
A certificate of postal equipment conformity shall be issued by the ARPCE when the approval is accepted.
The list of approved postal equipment shall be published by the APRCE.
- Renewal
The application for conformity certificate renewal must be introduced, at least, two months before its expiry, in the same conditions under which it was issued.
Any modification by the user or manufacturer to the equipment likely to modify its technical features shall be subject to the same procedure of granting a new certificate of conformity of the concerned equipment.
- Fees of applications handling
The fees concerning the handling of applications of postal equipment approval shall be fixed as follows:
– Non refundable fees of administrative file’s handling, amounting to ten thousand Algerian dinars (10000DZD) exclusive of tax, to be paid when submitting the approval application,
-Fees of technical study : amounting to forty thousand Algerian dinars (40000DZD) exclusive of tax, to be paid during the withdrawal of conformity certificate.
